Terms & Conditions 

  1. Acceptance of Terms

    1.1 - By accessing and using Mining Select, you agree to comply with and be bound by these terms and conditions. 
     

  2. Services 

    2.1 - The Platform provides a service for connecting mining companies and job seekers.

    2.2 - We reserve the right to modify, suspend, or terminate the Platform or any part of it at any time without notice. 
     

  3. User Accounts

    3.1 - Users must create an account to access certain features of the Platform. 

    3.2 - Users are responsible for maintaining the confidentiality of their account information and passwords.
     

  4. User Conduct 

    4.1 - Users agree not to use the Platform for any unlawful or prohibited activities. 

    4.2 - Users shall not engage in any conduct that disrupts the normal functioning of the Platform.

    4.3 - Mining Select reserves the right to remove any content which is deemed to violate the User Conduct standards, this includes: Harassment and Bullying: Engaging in or promoting harassment, bullying, or threats directed at individuals or groups. 
      4.3.1 - Hate Speech: Using discriminatory language or promoting hate speech based on race, ethnicity, gender,
                religion, sexual orientation, disability, etc. 
      4.3.2 - Illegal Activities: Posting content that encourages or facilitates illegal activities, including but not limited to
                hacking, fraud, or distribution of illegal substances. 
      4.3.3 - Explicit Content: Sharing explicit or adult content, including pornography or sexually explicit material.
      4.3.4 - Violence and Self-Harm: Promoting violence, self-harm, or suicide, or sharing content that glorifies or   
                   encourages harm to others. 
      4.3.4 - Impersonation: Impersonating another user, entity, or public figure with the intent to deceive or harm. 
      4.3.4 - Spam and Phishing: Posting spam, phishing attempts, or engaging in any form of deceptive practices to
                  obtain personal information. 
      4.3.5 - Privacy Violations: Sharing personal information of others without their consent or violating privacy rights. 
      4.3.6 - Intellectual Property Infringement: Posting content that infringes on copyrights, trademarks, patents, or 
                 other intellectual property rights. 
      4.3.7 - Misinformation and Fake News: Spreading false information or intentionally misleading content with the
                 intent to deceive.
      4.3.8 - Trolling and Disruptive Behavior: Engaging in trolling or disruptive behaviour that interferes with
                constructive discussions or the normal functioning of the platform. 
      4.3.9 - Unauthorized Access and Hacking: Attempting to gain unauthorized access to accounts, systems, or
                networks, or engaging in hacking activities. 
      4.3.10 - Gambling and Scams: Promoting or participating in gambling activities or sharing content related
                 to scams and fraudulent schemes. 
      4.3.11 - Violation of Terms of Service: Violating the terms of service, community guidelines, or any other rules set
                forth by the platform. 
      4.3.12 - Unsolicited Commercial Activity: Engaging in unsolicited commercial activities, such as advertising or
                promoting products or services without proper authorization. 
      4.3.13 -     Political Manipulation: Using the platform to spread misinformation for political purposes or engaging in
                manipulative activities related to political events.
     

  5. Job Postings and Applications 

    5.1 - Employers are solely responsible for the accuracy and legality of job postings. 

    5.2 - Job seekers are responsible for the accuracy and legality of the information provided in their applications. 
     

  6. Fees and Payments 

    6.1 - Fees are only refundable within the first 7 days of acceptance upon written instruction by the Client. 

    6.2 - All fees are fixed for a 3-month period 

    6.3 - Mining Select reserves the right to increase the fees after the 3-month period in accordance with acceptance by the Client. 

    6.4 - The Client will be invoiced monthly on a 30-day payment term.

    6.5 - Invoices will be sent immediately upon acceptance. 
     

  7. Intellectual Property 

    7.1 - The Platform and its content are protected by intellectual property laws. 

    7.2 - Users agree not to reproduce, distribute, or create derivative works from any content on the Platform without permission. 
     

  8. Privacy 

    8.1 - Our privacy policy outlines how we collect, use, and disclose user information. 

    8.2 - Users consent to the terms of the privacy policy by using the Platform. 
     

  9. Disclaimers 

    9.1 - We do not guarantee the accuracy, completeness, or timeliness of information on the Platform. 

    9.2 - The Platform is provided "as is" without any warranties. 
     

  10. Limitation of Liability 

    10.1 - We shall not be liable for any direct, indirect, incidental, special, or consequential damages. 

    10.2 - Our total liability, if any, shall not exceed the total fees paid by the user within the last 12 months. 
     

  11. Termination 

    11.1 - We may terminate or suspend user accounts and access to the Platform for violation of these terms. 
     

  12. Governing Law

    12.1 - These terms are governed by and construed in accordance with the laws of Australia 
     

  13. Changes to Terms 

    13.1 - We reserve the right to modify these terms at any time, and users are responsible for reviewing them periodically.

    13.2 - By using the mining recruitment software platform, you acknowledge that you have read, understood, and agree to these terms and conditions.
